01 · Nature and scope of the platform
Olhar™ is a global self-esteem platform that brings together technology, human care and information to help people see, smile and recognize themselves better. It is operated by Olhar Tecnologia Ltda. (company ID/CNPJ 67.685.757/0001-37), Uberaba/MG, Brazil.
Olhar is a technology and intermediation layer: it connects people to health and aesthetics providers. It is not a clinic, does not provide a health service and does not establish a doctor-patient relationship. Every clinical decision belongs to qualified professionals.
02 · Eligibility and accounts
Olhar is intended for people aged 18 or over with legal capacity. When you create an account, you declare that the information provided is true and undertake to keep it up to date.
Patient accounts and clinic accounts are distinct. Clinic access is a multi-user organization that handles patient data and financial information — each person is responsible for the use of their own credential.
03 · Authentication and access responsibility
Patient access uses an email sign-in link (no password). Clinic access uses the credentials provided to the organization. You are responsible for keeping your access means protected and for all activity carried out under your account.
Notify us immediately of any unauthorized use. We may end sessions and revoke access to protect the integrity of the platform and its users.
04 · Acceptable use
You agree to use Olhar lawfully and respectfully. You must not: submit unlawful or offensive content or content that violates third-party rights; upload images of people without authorization; attempt to bypass security, automation or technical limits; or use the platform for purposes other than those set out here.
05 · Intellectual property
The Olhar™ trademark (filed with Brazil's INPI), the name, visual identity, texts, software and other creations of the platform belong to Olhar Tecnologia Ltda. or its licensors. Using the platform does not transfer these rights to you.
06 · Content you submit
You retain ownership of the content you submit — for example, authorized photographs in a case handled by a clinic. You grant Olhar a limited license to host and process that content only to deliver the requested service, in accordance with the Privacy Policy.
You declare that you are authorized to submit the images and information you provide. Processing photographs as sensitive data occurs with specific consent and may be withdrawn at any time, as described in the Privacy Policy.
07 · Iris & Lux — preliminary guidance
Iris and Lux are artificial intelligences and always identify as such. They offer preliminary, educational guidance — never a diagnosis, prescription or treatment recommendation.
Olhar does not make automated clinical eligibility decisions. Clinical assessment and decisions always belong to qualified professionals.
08 · Olhar Design Studio 3D
The Olhar Design Studio 3D is a visual planning surface to support the conversation between you and a qualified professional. It is not a diagnosis, prescription, clinical guarantee or eligibility decision, and must not be read as a "before and after".
Reconstruction and planning depend on the quality and coverage of the images and preserve the person's identity. The Design Book represents a traceable professional hypothesis, never a promise of results.
An external reconstruction provider is only announced when actually active. Photographs and how images, derivatives and metadata are collected, used, retained and deleted are described in the Privacy Policy.
09 · No guarantee of clinical outcome
Olhar does not guarantee any clinical, aesthetic or other outcome. Visual references and simulations are inspirational and for discussion. Risks, indications and contraindications are assessed exclusively by qualified professionals, who are responsible for clinical decisions.
10 · Financing (viabilização)
When available, financing options are processed by a partner institution authorized by the Central Bank of Brazil. Olhar acts as a technology and experience layer. Nothing guarantees approval or the granting of credit, and every simulation is an estimate with the Total Effective Cost (CET) visible. Subject to credit assessment.
11 · Payments, cancellations and refunds
Payments, where they exist, are processed by a payment partner. Billing, cancellation and refund conditions follow what is stated at the time of contracting and the actual behavior of the service contracted, subject to applicable law.
12 · Availability, maintenance and termination
We aim to keep the platform available, but it may undergo maintenance, evolution or temporary unavailability. We may suspend or terminate features or accounts in case of a breach of these Terms, a legal requirement or the need to protect the platform and its users.
13 · Limitation of liability
To the extent permitted by applicable law, Olhar is not liable for clinical decisions made by professionals and clinics, for procedure outcomes, or for indirect damages arising from use of the platform. Nothing in these Terms removes rights that the law grants the consumer on a non-waivable basis.
14 · Changes to these Terms
We may update these Terms to reflect changes in the service or in the law. When that happens, we change the effective date at the top and, for material changes, we notify you through the platform's channels. The version in force is always the one published here.
15 · Governing law, jurisdiction and contact
These Terms are governed by Brazilian law. The consumer's domicile is the elected jurisdiction to settle disputes, where applicable. Questions about these Terms may be sent through Olhar's official channels; privacy and data matters, to the Olhar Privacy Channel: dpo@olhar.net.
